Miami-Dade Booking Photos Online: How to Access and Verify County Jail Inmate Records
A persistent source of confusion for individuals researching arrest records stems from third-party mugshot aggregation websites. These commercial operators scrape county booking portals automatically, index booking photos on external servers, and rank them aggressively on public search engines. Even after an individual posts bond or has their charges completely dismissed, their mugshot often lingers on non-government sites.
Florida addressed this extortion-adjacent industry directly by enacting Florida Statute § 901.43. Under this law, any commercial website operator who publishes an arrest booking photograph and subsequently demands payment, a fee, or other consideration to remove, correct, or modify that photo commits an actionable violation. If the person pictured submits a written request for removal via certified mail or registered electronic delivery, the site operator must remove the photo within 10 calendar days at zero cost.
Failure to comply exposes the site operator to civil penalties, civil injunctions, and mandatory attorney fees. If a commercial site refuses to remove an image after a formal notice, especially in cases where criminal charges were dropped, expunged, or resolved via acquittal, the affected party can pursue damages under Florida's Deceptive and Unfair Trade Practices Act. Legitimate verification should always bypass these predatory sites entirely in favor of government-hosted archives.
